Being permitted to telecommute can be a reasonable accommodation under the Americans with Disabilities Act. But take a case-by-case approach.

  • I‘ve seen ways around this. Some companies are using Basecamp or Elance which have accountability for the employee. They have to "login" and their computer takes screen shots of what they are working on, so if they get caught goofing off looking at their Facebook or personal emails a lot, then working at home is probably not ideal for that type of person.
